Terms of Service

1. Agreement

These Terms form a legal agreement between you and the sole proprietor operating under the SignalMoth brand from Ho Chi Minh City, Vietnam. SignalMoth is the sole-proprietor brand under which the service is provided; it is not a separate legal entity or company. In these Terms, “SignalMoth,” “we,” “us,” and “our” refer to that sole proprietor.

These Terms govern your use of the public website at signalmoth.com, the editor at app.signalmoth.com, and related account, billing, and AI services. By accessing or using the service, you agree to these Terms. The Privacy Policy explains how SignalMoth handles personal information, and the Refund Policy explains cancellation and refund handling. If you do not agree to these Terms, do not use the service. If you use SignalMoth for an organization, you confirm that you have authority to bind that organization, and “you” includes it.

2. Eligibility and accounts

You must be at least 13 and legally capable of entering a binding agreement. If you are under the age of legal majority where you live, a parent or guardian must review and agree to these Terms on your behalf before you use SignalMoth.

You are responsible for accurate account information, the security of your identity-provider account and devices, and activity performed through your SignalMoth session. Notify admin@signalmoth.com promptly if you suspect unauthorized access. You may not share session credentials or impersonate another person or organization.

3. The service

SignalMoth is a local-first editor for building animated causal stories. Features may include local project recovery, portable exports, review links, authentication, AI-assisted drafting, and paid usage entitlements.

Local projects are stored in your browser by default. You are responsible for maintaining exports or backups you need. Clearing browser data, losing a device, using private browsing, or browser storage limits can remove local work. SignalMoth does not promise that a local project can be recovered after its browser storage is lost.

4. Your content

As between you and SignalMoth, you retain ownership of project content, prompts, files, and other material you create or submit. You give SignalMoth a limited, non-exclusive license to process that content only as needed to provide, secure, and support the features you choose, such as generating an AI draft. Project exports and review links are generated locally in your browser unless a feature clearly tells you otherwise.

You are responsible for your content and for having the rights needed to use, upload, transform, export, or share it. Review links and exported files can disclose content to anyone who receives them. You decide who receives them and should remove secrets, personal information, or confidential material that recipients should not see.

5. AI features

AI features may generate incomplete, inaccurate, unsafe, biased, or non-unique output. You must review and validate output before applying, publishing, or relying on it. SignalMoth does not represent that AI output is correct, original, or suitable for any particular use.

Do not submit content that you are not permitted to send to an AI provider. Do not use AI output as a substitute for qualified professional judgment, particularly for safety, emergency, security, medical, legal, or financial decisions. AI usage is subject to plan, rate, concurrency, and budget limits, and a failed provider request may not always produce an output.

6. Acceptable use

You may not use SignalMoth to:

• violate law, another person's rights, or a contractual duty;
• upload or distribute malware, exploit code, or unlawfully harmful content;
• harass, deceive, impersonate, defraud, or facilitate abuse of another person;
• probe, disrupt, overload, bypass, or compromise the service or its security controls;
• evade usage limits, share access credentials, or automate access without permission;
• reverse engineer the service except where that restriction is prohibited by law; or
• use the service to build or operate unlawful surveillance or high-impact decisions about a person.

SignalMoth may investigate suspected abuse and restrict access where reasonably necessary to protect users, providers, or the service.

7. Plans, one-time purchases, subscriptions, and billing

Current plan features, prices, usage limits, and availability are shown on the pricing page, in the application, or at checkout. Taxes and currency handling may depend on location. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all SignalMoth orders. Paddle handles checkout, payment, taxes, receipts, subscription payment management, refunds, and buyer payment support, while SignalMoth provides the service, entitlements, and product support. The Paddle Buyer Terms, Paddle Privacy Policy, and our Refund Policy also apply to the transaction.

SignalMoth does not offer Story Packs for new purchase. If an account has a valid legacy Story Pack transaction or credited balance, that transaction was a one-time purchase, not a subscription, and does not renew automatically. Any verified unused AI actions do not expire. A purchase is credited only after payment is confirmed. An approved full refund, credit, chargeback, or chargeback warning may remove unused purchased actions. A verified reversal may restore actions previously removed for that event. These adjustments remain subject to applicable law and the terms presented at checkout.

A recurring subscription automatically renews for successive billing periods matching the interval shown at checkout until you cancel it. By subscribing, you authorize Paddle to charge the applicable price and taxes at each renewal. You may cancel at any time through SignalMoth's billing portal, the manage link in a Paddle receipt, Paddle's customer portal, or Paddle.net. Cancellation takes effect at the end of the current paid billing period: paid access normally remains available until then, and Paddle will not charge the next renewal, unless a refund, reversal, account suspension, or applicable law requires a different result.

Refund eligibility is described in the Refund Policy and remains subject to mandatory consumer law and the terms presented at checkout. SignalMoth can help investigate a product or entitlement issue; approved transaction refunds are issued by Paddle as Merchant of Record. Contact SignalMoth or Paddle promptly if a charge or entitlement appears incorrect.

SignalMoth may change plans or prices prospectively, subject to any notice required by applicable law or the checkout terms. Changes do not override a price-hold or other commitment expressly shown for an uninterrupted subscription. If payment fails or a subscription is paused, canceled, or past due, subscription entitlements may be limited or removed. SignalMoth may separately issue a time-limited service grant for evaluation or partnership use. A grant is not a purchase, is not transferable or redeemable for cash, and ends when its stated period expires or it is revoked.

8. Third-party services

SignalMoth relies on services such as Auth0, Google, OpenAI, Paddle, Cloudflare, and Render. Their terms and privacy practices may apply when you interact with them. SignalMoth is not responsible for third-party services, outages, or content outside its reasonable control, but it remains responsible for its own obligations under these Terms and applicable law.

9. SignalMoth ownership

SignalMoth and its licensors retain rights in the service, software, branding, documentation, templates, and other materials they provide, excluding your content. These Terms do not grant a right to use SignalMoth trademarks or branding except to identify the service accurately.

10. Suspension and termination

You may stop using SignalMoth at any time and may request deletion of eligible account data. SignalMoth may suspend or terminate access for a material breach, unlawful activity, security risk, nonpayment, provider requirement, or discontinuation of the service. Where reasonable, SignalMoth will provide notice and an opportunity to export local work or address the issue.

Provisions that by their nature should continue after termination remain in effect, including ownership, payment obligations, disclaimers, liability limits, and general terms.

11. Disclaimers

To the maximum extent permitted by law, SignalMoth is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or error-free operation. Mandatory rights that cannot lawfully be excluded remain unaffected.

SignalMoth is a visualization and authoring tool, not professional advice or an execution, monitoring, emergency-response, or safety system. You remain responsible for decisions, controls, testing, and real-world outcomes based on a diagram or story.

12. Limitation of liability

To the maximum extent permitted by law, SignalMoth will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities arising from the service.

These limits do not apply where liability cannot lawfully be limited.

13. Changes to the service or Terms

SignalMoth may update features and these Terms. Material changes will be announced on the site or in the application when appropriate, and the effective date will be revised. Changes apply prospectively. Continuing to use the service after updated Terms take effect means you accept them, except where law requires another form of consent.

14. General terms

These Terms do not limit mandatory consumer protections that apply to you. Disputes may be brought before a court with competent jurisdiction under applicable law. If part of these Terms is unenforceable, it will be limited to the minimum extent necessary and the remaining terms will continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign these Terms in connection with a transfer of SignalMoth or its assets to another operator, with appropriate notice and subject to applicable law.

These Terms, the Refund Policy, and terms presented for a specific plan or checkout form the agreement for the service. The Privacy Policy is a notice about personal information, not part of this agreement. Specific written terms control if they expressly conflict with these general Terms.
